Terms of Service
1. Acceptance & Eligibility
By tapping "I Agree" at first launch, you accept these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the app.
You must be at least 13 years old (or the minimum age required by your jurisdiction) to use Health Recall. These Terms are versioned; a material change increments the required version and requires re-acceptance before you can continue.
2. Description of Service
Health Recall is a recall-information aggregator. It displays data sourced from public FDA, USDA, and CPSC records, together with developer-produced derived content:
- Risk scores: automated heuristic estimates. Not an official government classification and may be inaccurate.
- Early Signals: unconfirmed news reports matching recall keywords. They may not reflect an actual recall.
- Grocery-store alerts: recall news associated with named retailers. Health Recall is not affiliated with or endorsed by any retailer.
The app is not a substitute for official FDA/USDA/CPSC notices.
3. Disclaimer of Warranties
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR TIMELINESS.
4. No-Reliance / Assumption of Risk
Health Recall is an informational tool only. You assume full responsibility for any action you take based on app content.
Always verify recall information directly at recalls.gov or by contacting the relevant government agency before acting — especially where health or safety is at risk.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAVID WAYNE YOWELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Indemnification
You agree to indemnify and hold harmless David Wayne Yowell from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the app or violation of these Terms.
7. Third-Party Content
News headlines and links belong to their respective publishers. Store names and trademarks belong to their owners. Health Recall is not affiliated with, sponsored by, or endorsed by any news publisher or retailer whose name appears in the app. Store names are used solely to identify publicly reported recalls.
8. Government Data
Recall data is sourced from public FDA, USDA, and CPSC records. Health Recall is not affiliated with, operated by, or endorsed by any government agency.
9. Changes to Terms
We may update these Terms at any time. Material changes increment the required version. The app will present the updated Terms on your next launch and require re-acceptance.
10. Dispute Resolution
These Terms are governed by the laws of Texas without regard to conflict-of-law principles.
If you have a dispute with Heath Recall, you agree to first contact us at support@healthrecall.app to try to resolve the issue informally. If we cannot solve the problem within 60 days, either party may start a formal proceeding.
Any disagreement that cannot be resolved informally must be settled through binding arbitration, rather than in court. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules. The hearing will happen in the county of your billing address or another mutually agreed place.
You and Health Recall agree that disputes can only be brought on an individual basis. Neither you nor the company can join claims in a class, consolidated, or representative action.
11. Apple EULA
Apple's standard end-user license agreement also applies to your use of this app. Apple is not a party to these Terms and has no responsibility for the app or its content.
